Online shop terms and conditions of sale

These terms and conditions apply to every order and every quote through this online shop, for consumers and businesses alike.

1. Who we are

This online shop is operated by Corswarem Window Creations BV, Vrijheidweg 1, 3700 Tongeren-Borgloon (registered office: Negende Liniestraat 19 A, 3200 Aarschot), company number/VAT number BE0683764183 (RLE Leuven), email info@corswarem.eu, telephone +32 12 260 170 ("we", "Corswarem"). The quickest way to reach us is via the contact form.

2. Scope and definitions

These terms and conditions apply to every offer, order and contract made through this online shop, and to every quote arising from it, with consumers and business customers alike. By placing an order, you accept them. Business customers' own terms of purchase do not apply, even if they appear on their order. Deviations apply only if we confirm them in writing.

  • Consumer: anyone who orders for purposes outside their trade or profession. Business customer: any business, self-employed person or association that orders for professional purposes.
  • Standard item: a product from stock that we supply as shown in the online shop and that can be sent by parcel service. Large items (solar panels, mounting systems, letterboxes) and all lengths are collected or sent by separate transport, with the cost calculated at checkout; the online shop indicates this on the product page and in your cart.
  • Made-to-measure product: any product made to your measurements, in your colour or according to your choices, in particular anything you configure with a configurator (made-to-measure fly screens, façade cladding, letterboxes in a non-standard colour) and anything supplied on the basis of a quote.

3. Offer, prices and configurator

Prices are in euros. For consumers they include VAT; quotes and invoices for business customers also show them excluding VAT. Shipping or transport costs are shown separately at checkout, before you pay. Prices may change up to the moment you place your order; once you have ordered, your price is fixed.

The price of made-to-measure products is calculated on the basis of the measurements and choices you enter. Drawings, cross-sections and 3D images in the configurator are a schematic representation to clarify your choices; they are not a technical plan and do not show exact profile dimensions. Obvious errors, misprints or a price that is clearly incorrect are not binding on us; in that case we will notify you and you may cancel the order free of charge.

Photos and colours on a screen may differ from the actual product. RAL colours are coated to accepted industry standards; slight differences compared with a sample or between production batches are not defects.

Photos are for illustration only and may show accessories that are not included in the price. Promotions and offers are valid while stocks last, unless another period is stated.

4. Orders and contract

An order is final when you confirm and pay for it, or choose to pay by bank transfer. You will receive a confirmation by email. We may refuse an order within 2 working days or amend it in consultation with you, for example in the case of measurements that cannot be produced, an unavailable item or suspected fraud; any amount you have already paid will then be refunded.

A quote is valid for 30 days. If you order on the basis of a quote, the measurements, quantities and prices in that quote and these terms and conditions apply. A quote request via the online shop does not commit you to anything.

5. Made-to-measure products: your measurements, your responsibility

Made-to-measure products are made exactly as you order them. The measurements, colour, quantity, angles, openings and all other choices that you enter or confirm in a quote are your responsibility. We produce what you order and cannot assess the situation on site.

  • Our check of an order before production is an additional service. It does not shift responsibility for the measurements and choices to us, even if we contact you and you confirm your choice.
  • For façade cladding and other projects, we send a shop drawing. Your approval of that drawing is binding and constitutes the final order; we then start production.
  • Once production has started or the material has been ordered, made-to-measure products can no longer be changed or cancelled. If a measurement or choice turns out to be wrong, we will make a new one at your expense.
  • Deviations of up to 2 mm in the measurements, customary differences in colour and texture, and visible cut edges or joints inherent to the product are not defects.
  • Made-to-measure products are not covered by the right of withdrawal (Article 9). They are intended to be installed by you or your installer; installation and the suitability of the substrate are your responsibility, unless we expressly include installation in a quote.

6. Payment

You pay in advance, using one of the payment methods shown at checkout: online with your debit or credit card via our payment service provider Stripe, or by bank transfer. If you choose bank transfer, we expect payment within 7 days; after that, the order lapses. Made-to-measure products only go into production after payment in full or, in the case of a quote, after payment of the deposit stated on the quote (normally 40%), with the balance due before delivery or collection.

Business customers can order on invoice once we have approved this. Invoices are payable within 30 days of the invoice date. In the event of late payment by a business customer, interest is due by operation of law and without prior notice of default in accordance with the Act of 2 August 2002 on combating late payment in commercial transactions, plus a fixed sum of €40 as compensation for recovery costs and liquidated damages of 10% of the outstanding amount, with a minimum of €125, and we may suspend pending orders.

In the event of late payment by a consumer, we first send a free reminder with a payment period of 14 calendar days. After that, default interest at the statutory interest rate and lump-sum compensation are due, as permitted by Book XIX of the Belgian Code of Economic Law.

Products delivered remain our property until they have been paid for in full. Until then, you may not resell, process or pledge them. If anyone seeks to seize them, you must inform them of our retention of title.

7. Delivery, transport and collection

The practical arrangements (shipping costs, home delivery, collection, delivery times) are set out on our Delivery & returns page and form part of these terms and conditions.

Delivery times are an estimate. Late delivery does not entitle you to compensation or a discount, nor to refuse the delivery. If we do not deliver within 30 days of the stated delivery time, you may give us an additional reasonable period; if delivery still does not take place, you may terminate the contract and we will refund what you have paid.

For consumers, the risk of loss or damage passes to you at the moment you, or someone you designate, take receipt of the product. For business customers, the risk passes when the goods leave our warehouse, even if we arrange the transport. We deliver long lengths as far as the street or driveway; unloading is done with your help.

Orders for collection are ready from the moment we notify you. From the 60th day after that notification, we may charge a storage fee of €5 per week or part of a week.

8. Inspection on receipt

Check your delivery straight away. Note any visible transport damage on the delivery note and report it to us within 2 working days with photos, so that we can claim compensation from the carrier. For business customers, a delivery is deemed accepted as regards visible defects, quantities and dimensions if no complaint is made within 2 working days. Consumers retain their statutory rights in all cases.

9. Right of withdrawal (consumers)

As a consumer, you have 14 calendar days from receipt to withdraw from the purchase of an item without giving any reason, except in the cases below. For how this works and which model withdrawal form you can use, see Delivery & returns. You bear the cost of returning the item. If the item has been used beyond what is necessary to assess it, we may deduct the diminished value from the refund.

The right of withdrawal does not apply to made-to-measure products: products made to your specifications or clearly personalised for you (Art. VI.53, 3° of the Belgian Code of Economic Law). Nor does it apply to ONZO letterboxes, even in a standard colour, which we order specially for you from the manufacturer, to sealed products that have been unsealed after delivery and cannot be returned for reasons of hygiene or health protection, or to business customers.

10. Guarantee

Consumers benefit from the statutory guarantee of two years from delivery for defects that existed at the time of delivery. Report a defect no later than two months after you discover it. We will repair or replace the product, at our discretion, provided this does not cause you significant inconvenience; if that is impossible or unreasonably expensive, you will receive a price reduction or a refund. Manufacturers' commercial guarantees are stated on the product page and apply in addition, under their own terms.

To make a warranty claim, we will ask for your proof of purchase (invoice or order confirmation). We also recommend keeping the original packaging.

For business customers, a guarantee of twelve months from delivery applies to hidden defects in the product itself. It covers repair or replacement of the product, not the costs of removal, installation, travel or downtime.

The guarantee does not cover: normal wear and tear; discolouration and loss of gloss within accepted standards; damage caused by incorrect installation, incorrect use, overloading or lack of maintenance; damage caused by abnormal weather conditions or other abnormal circumstances; modifications or repairs by yourself or third parties; and defects resulting from measurements, choices or plans that you supplied.

11. Liability

Our liability is limited to the price of the product concerned. We are not liable for indirect loss or damage such as loss of time, loss of profit, third-party costs or damage to other goods, except in the case of wilful misconduct or gross negligence. We give advice on measuring, installation or use to the best of our ability and without obligation; installation by yourself or by a third party is at your own risk. These limitations do not affect the mandatory rights of consumers.

12. Force majeure

If we are unable to fulfil an obligation, or to fulfil it on time, due to circumstances beyond our control (such as a strike, a shortage or delay at a supplier or carrier, a breakdown, a pandemic or extreme weather), our obligations are suspended for as long as those circumstances last. If this lasts longer than 60 days, either party may cancel the order free of charge; any amount you have already paid will be refunded.

13. Intellectual property

Our profiles, drawings, photos, texts, the configurator and the shop drawings are and remain our property. You may use them only for your own order; you may not copy or distribute them, or use them to have the products copied elsewhere.

14. Privacy

We process your data as described in our privacy statement.

15. Complaints and disputes

If you have a complaint, let us know via the contact form; we will work with you to find a solution. If that does not work out, as a consumer you can turn to the Consumer Mediation Service (consumerombudsman.be).

Belgian law applies. Disputes with business customers fall within the jurisdiction of the courts of our registered office (Leuven). For consumers, the statutory rules on jurisdiction apply.

16. Final provisions

If any provision of these terms and conditions is void, the other provisions remain in force and the void provision is replaced by a valid one that comes closest to its intention. We may amend these terms and conditions; an order is governed by the terms and conditions published on the online shop at the time of the order.

If we do not (immediately) enforce a right under these terms and conditions, this does not mean that we waive it. Emails and the details of your order in our systems serve as evidence.
